A sudden fall can leave you in pain, confused, and unsure what to do next. Whether it happened at a store, apartment complex, or business, taking the right steps early on can protect both your health and your rights.
1. Seek Medical Attention
Even if you feel okay, injuries from falls can worsen over time. A medical evaluation not only ensures your safety—it creates a medical record that can support your case.
2. Report the Incident
Let the property owner or manager know what happened. Ask them to document it and request a copy of any incident report. Be clear and factual—avoid exaggeration or speculation.
3. Document the Scene
If you’re able, take photos or videos of the location, any hazards (wet floors, broken stairs, poor lighting), and your injuries. Ask witnesses for their names and contact info.
4. Don’t Give a Statement Yet
Insurance adjusters may reach out quickly. It is best to avoid providing a recorded statement or signing anything until you’ve spoken with a lawyer.
5. Contact a Premises Liability Lawyer
Time matters. Evidence can disappear. A lawyer can send a preservation letter, investigate quickly, and explain your options clearly—before the other side builds their defense.
At Recalde Law, we’ve helped countless clients after unexpected falls. We know how to deal with insurers and pursue claims with focus and care. There are no upfront costs—and no fee unless we win.
